1. Acceptance

By downloading, installing or using the MyFoodScan application ("the Application"), you accept these Terms of Service ("Terms"). If you do not accept these terms, do not use the Application.

3. Service description

MyFoodScan is a food label reading aid application that allows you to scan product barcodes and identify allergens, additives and FODMAP ingredients they contain, based on the Open Food Facts database and, in Premium option, additional analysis by artificial intelligence.

4. Medical disclaimer

The Application provides information for guidance only. It is not a medical device and does not replace the advice, diagnosis or treatment of a healthcare professional. Always verify the physical product label before consumption. In case of severe allergy or medical condition, consult a doctor.

5. Premium subscription

The Application offers a Premium subscription at €1.99 per month (or equivalent in your local currency), including unlimited scans and AI ingredient analysis.

• The subscription is managed by Apple (App Store) or Google (Play Store) depending on your platform.
• Payment is charged to your Apple ID or Google Play account.
• The subscription auto-renews at the end of each period unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID or Google Play account settings.

6. Right of withdrawal (EU)

Under European law, you have a 14-day right of withdrawal after subscribing. However, by starting to use the Premium service, you expressly waive this right of withdrawal for the portion already consumed. To exercise your right, contact Apple or Google depending on your platform.

7. Acceptable use

You agree to use the Application in accordance with its intended purpose and not to:

• Attempt to circumvent technical limitations (in particular the free scan counter)
• Reverse engineer, decompile or disassemble the Application
• Use the Application for commercial purposes without authorisation
• Submit unlawful, defamatory content or content infringing third-party rights

8. Intellectual property

The Application, its code, graphics, content and the MyFoodScan trademark are protected by intellectual property law. Product data comes from the Open Food Facts community database under the ODbL licence.

9. Limitation of liability

The publisher cannot be held liable for direct or indirect damages resulting from the use or inability to use the Application, in particular:

• Decisions made on the basis of displayed information
• Errors, omissions or inaccuracies in Open Food Facts data
• Service interruptions or unavailability

The Application is provided "as is", without warranty of completeness or accuracy of results.

10. Personal data

The processing of your data is governed by our Privacy Policy, which is an integral part of these Terms.

11. Changes

These Terms may be modified at any time. Any material change will be notified in the Application. Continued use of the Application after notification constitutes acceptance of the new terms.

12. Termination

You can stop using the Application at any time by uninstalling it. The publisher may suspend or terminate your access in case of breach of these Terms.

13. Applicable law and disputes

These Terms are governed by French law. In case of dispute, and after attempting amicable resolution (contact us at the address above), French courts shall have sole jurisdiction, subject to mandatory consumer protection provisions.
